Mediation, will it now indeed become a common legal ADR tool in the Netherlands?

Following the rather belated implementation in Dutch legislation of ‘Directive 2008/52/EC of the European Parliament and the Council of 21 May 2008 on certain aspects of mediation in civil and commercial matters’ in November 2012, Dutch parliamentarian Mr. Ard van der Steur, by means of political initiative, recently on 26 May 2013 filed a bill (actually three) to incorporate mediation in Dutch law. Mediation can be described as a form of dispute resolution in which an independent third party, the mediator, assists the parties to, for their mutual benefit, jointly and from their own free will try to find a solution to a mutual conflict.

The recent opening of the Shanghai Free Trade Zone (FTZ) has created a lot of press and as result many companies are considering to choose the FTZ for their presence in China.  The Shanghai FTZ was established in 2013 to serve as a pilot project and testing ground for further economic reforms and opening up of China. The zone especially focuses at opening up the service sector for foreign investment, with lesser restrictions than outside of the Zone.
